1. Acceptance of terms
By accessing or using the Trans Nzoia County Projects Monitoring and Tracking System (PMTS) public website and related digital services (the “Service”), you agree to these Terms of Use. If you do not agree, please discontinue use except for viewing publicly available information permitted without registration.
These terms apply alongside our Privacy Policy, Cookie Policy, and Data Protection Statement.
2. About PMTS
PMTS is an official county platform established to monitor and publish information on development projects, financial years, departments, implementing agencies, public statistics, documents, updates, and citizen feedback. Its objectives include transparency, accountability, efficient service delivery, and evidence-based planning for Trans Nzoia County residents and stakeholders.
3. Eligibility and accounts
- Most public content is available without an account.
- Staff accounts are provisioned by county administrators for official duties only.
- You must provide accurate registration information and keep credentials confidential.
- You are responsible for activity under your account and must notify the county immediately of unauthorized use.
- The county may suspend or terminate accounts that violate these terms or pose a security risk.
4. Permitted use
You may use the Service to:
- View published projects, maps, statistics, downloads, and county updates;
- Submit good-faith feedback and enquiries related to county projects and services;
- Share links to public pages with proper attribution to Trans Nzoia County PMTS;
- Reuse publicly published statistics and documents in accordance with applicable open-government and copyright law, citing the source.
5. Prohibited conduct
You must not:
- Attempt unauthorized access to staff areas, APIs, databases, or user accounts;
- Introduce malware, scrape the Service in a manner that impairs performance, or launch denial-of-service attacks;
- Submit false, defamatory, harassing, hateful, or unlawful feedback or content;
- Impersonate any person or misrepresent affiliation with the county;
- Harvest personal data of other users without lawful basis;
- Circumvent cookie consent, accessibility controls, or security measures;
- Use automated tools to bulk-download restricted or non-public data.
Violations may result in blocked access, removal of content, and referral to law enforcement where appropriate.
6. Content and intellectual property
County logos, branding, curated PMTS content, dashboards, and original materials are protected by applicable intellectual property laws. Project data published for transparency remains subject to county ownership and third-party funding partner attributions where displayed on project records.
User-submitted feedback grants the county a non-exclusive licence to store, moderate, publish (where applicable), and respond to your submission for transparency and service improvement purposes.
7. Accuracy and availability disclaimer
PMTS data is compiled from departmental submissions and quality-assurance workflows. While we strive for accuracy and timely updates, information may contain errors, delays, or omissions. Published figures are indicative and should not be the sole basis for legal, financial, or contractual decisions without official county confirmation.
The Service is provided on an “as available” basis. We may modify features, perform maintenance, or suspend access with reasonable notice where practicable.
8. Citizen feedback and moderation
Feedback may be reviewed before publication. The county may redact personal contact details, remove abusive content, or decline publication that is off-topic, spam, or incompatible with public-interest transparency. Official responses represent the county’s position at the time posted and may be updated as projects evolve.
9. Third-party services
Maps, charts, embedded media, email delivery, and consent tools may rely on third-party providers. Your use of those features may be subject to additional terms. See the Cookie Policy for cookie-related providers including CookieYes.
10. Limitation of liability
To the fullest extent permitted by Kenyan law, Trans Nzoia County Government and its officers, employees, and agents shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Nothing in these terms excludes liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify the county against claims arising from your misuse of the Service, violation of these terms, or infringement of third-party rights through content you submit.
12. Governing law and disputes
These terms are governed by the laws of the Republic of Kenya. Disputes should first be addressed through county contact channels. Where unresolved, competent courts in Kenya shall have jurisdiction unless mandatory consumer protection rules provide otherwise.
13. Changes to terms
We may revise these Terms of Use. Updated terms take effect when posted with a new “Last updated” date. Material changes affecting registered users may additionally be communicated by email where appropriate.
